Any matter not expressly provided for in these Terms and Conditions shall be understood to be reserved for MONPIEL, without prejudice to the application of the provisions of the regulations in force.

The ticking of the corresponding box on the acceptance of these Terms and Conditions, as well as the fact of following telematically all the steps of this, implies the express acceptance of the same by the User, having the same validity as his or her handwritten signature. In this way, the User acknowledges being a person with sufficient capacity to acquire the obligations arising from their actions through the Website, who has previously read and understands its content.

In any case, in order to contract with MONPIEL, the User must be of legal age (+18 years) and have the necessary legal capacity to enter into contracts.

The User undertakes to make proper use of the Website, in accordance with applicable laws, good faith, public order and the Terms and Conditions.

The User shall be liable to MONPIEL, or to third parties, for any damages that may be caused as a result of a breach of its obligations.

Without prejudice to the foregoing, depending on the product that the User has purchased, it may be subject to particular conditions, depending on the characteristics of the product itself. These particular conditions are found in these Terms and Conditions.

  1. ACCESS AND USE

The Website and its services are free and open access, however, MONPIEL conditions the use of some of the services offered on the Website to the prior completion of the corresponding form.

Access to the Website by minors is prohibited. However, in case of access to the Website by a minor, it will be presumed that such access has been made with prior express authorization from their parents, guardians or legal representatives, notwithstanding that MONPIEL reserves the right to make any verifications it deems appropriate.

The User guarantees the authenticity and timeliness of all data communicated to MONPIEL, being solely responsible for any false or inaccurate statements made.

Access and navigation on the Website do not require registration, although to make any purchase or to receive advertising, information and periodic offers of promotional campaigns and our products, it will be necessary to complete the web forms provided for that purpose.

In accordance with the provisions of the applicable regulations, contracts concluded by electronic means will produce all the effects provided by the legal system when the consent and other requirements necessary for their validity concur. In any case, the electronic support in which the contract concluded by electronic means is recorded shall be admissible as documentary evidence in case of dispute between the parties.

The monitoring of all phases of the purchase process and, where appropriate, the payment of the corresponding economic amount, necessarily imply the provision of the consent required for the contracting.

The Terms and Conditions shall be freely and freely available to Users at all times on the Website.

MONPIEL will introduce adequate and sufficient technical means to identify and correct technical errors in the management of the information as soon as it is under its responsibility.

The language in which the contracting procedure will be processed and in which this contract is formalized shall be, unless otherwise indicated, Spanish.

  1. PURCHASE PROCESS

The contracting of the products offered is carried out electronically through the Website. Any person with Internet access can make the purchase, being of public access all the products offered through the Website, without any restriction for its visualization.

After accessing the Website, the User must select those products that interest him, being very important to review their descriptions, as well as their characteristics, conditions, delivery times and final prices indicated in the descriptive card of each product, and specify the units you want of each of them. In order to continue with the purchase, it is necessary to have all the data of the User. Also, the User must complete the data relating to the control of billing and shipping of products. To this end, the User will go to a screen in which a series of personal and bank details will be required, as well as the selection from a series of options offered by MONPIEL, whose completion is essential to complete the purchase of the products through the Website.

With respect to the "PAYMENT METHOD" tab, the User must only enter the desired payment method from among those offered by MONPIEL on the Website. At no time MONPIEL will have access to your bank details, these being directly managed by the corresponding banking entities. The User is informed that the payment through any of these methods may be subject to the particular conditions of these providers. MONPIEL recommends the User to read, know and accept the particular conditions of MONPIEL, which are independent of these Terms and Conditions.

After the payment is made, the User will receive an e-mail confirming the order, which will include a summary of the items purchased, the shipping method requested and the destination address.

If at the time of payment there is an incident that prevents payment, the User will receive an automatic payment error message and your order will not be processed until the payment process is successfully completed.

MONPIEL markets leather goods, footwear and fashion accessories.

The data included on the Web site in each description of the products, in their photographs, graphic or iconographic representations or videos, as well as trade names, trademarks or distinctive signs of any kind, have a purely informative function. Therefore, MONPIEL declines any responsibility for the appearance of errors in such information, although it undertakes to take all measures within its power to correct as soon as possible the referred errors or omissions after having been informed of them.

  1. CONOMIC CONDITIONS

  • PRODUCT PRICE

Each product will have the price indicated at any given time on the Website next to its description, being publicly accessible on the Website for viewing.

Prices are shown in Euros, unless otherwise expressly indicated.

The prices shown are final prices, expressly including Value Added Tax (VAT) and any other applicable expenses. Notwithstanding the foregoing, the final price will include all those increases or discounts that are applicable, expenses charged to the User and additional costs for ancillary services, payment methods, etc.. In any case, all these amounts will be shown to the User in an itemized manner during the contracting process.

  • PROMOTIONAL CODES

MONPIEL may periodically offer discount codes to its Users. Such discounts may only be applied in accordance with the instructions specified by MONPIEL with respect to each code, and in any event Users may only use a single code per order.

The use of discount codes will not be compatible with certain promotional actions and collections.          

  • PAYMENT PROCESS

Once the User has contracted any of the products corresponding to the Website and paid the payment through any of the methods made available to Users by MONPIEL, MONPIEL will send the User an e-mail containing all the information relating to the products purchased, their price, applicable taxes and any other information required by law.

In any case, the payment of economic amounts through the Internet will be made through the platform provided by an external financial institution, which in any case will be hosted on a website under SSL secure protocol. For your identification, please confirm that the web address of the page from which you will make the payment starts with https://.

The contracting will only be effective when MONPIEL receives confirmation of payment by the bank owning secure payment. If the transaction is for any reason denied by said entity, or the full amount corresponding to the amount of the products (including surcharges for management costs and bank transfer fees) is not provided, the contracting will be suspended, informing the User that the transaction has not been finalized.

By accepting these Terms and Conditions, the User expressly consents to receive the invoice electronically, if so requested. If the User wishes the invoice on paper, he/she may contact MONPIEL indicating the postal address to which the invoice should be sent.

Also, in accordance with current legislation, MONPIEL may not subsequently modify the invoicing of sales made. Therefore, the invoice will be issued in the name of the natural person who contracts the Services, so the User must ensure that the order is placed in the correct name, not being able to issue duplicate invoices to send them to third parties, nor can these be issued after the warranty period has elapsed.

  • Payment options and methods of payment

For one-time purchases we accept the following credit and debit cards: Visa, Visa Electron, MasterCard, Maestro.

In the case of single purchase we also support the use of PayPal or payment through "Aplazame".

In order to provide you with "Aplazame" payment methods, we may send "Aplazame" your personal data in the form of contact as well as order details in the payment process, in order for "Aplazame" to assess whether you qualify for their payment methods and also to adapt the payment methods available to you. Your transferred personal data is processed in accordance with the privacy notice of "Aplazame".

MONPIEL undertakes that the contents, data or information relating to the products offered on its Website are reliable, truthful and accurate, taking responsibility for the prices and characteristics advertised. However, it shall not be responsible for any information that has been introduced, displayed or modified by third parties outside MONPIEL.

The photographs, texts, graphics, information or characteristics reproduced that illustrate the products for sale are merely illustrative and are not contractual, so they may vary. However, we always ensure that the description of the products is as accurate as possible.

MONPIEL shall not be liable in case of unavailability of the product or impossibility of delivery when this is due to force majeure, theft or loss, or error in the order or data provided by the User. However, in such cases, MONPIEL may contact the User to try to find the best solution to the case.

  1. MODIFICATIONS

MONPIEL reserves the right to carry out modifications or updates to these Terms and Conditions, of which the User will be previously informed for acceptance or rejection in case they are substantial.

The User shall be deemed to have expressly accepted such modifications or updates in the following cases: at the time of making a new purchase will have to expressly accept the new Terms and Conditions.

  1. SUSPENSION OF THE WEBSITE

MONPIEL reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, the access, browsing, use, hosting or downloading of content or use of services of the Website, with or without prior notice, to Users who contravene any of the provisions detailed in these Terms, without the possibility for the User to demand any compensation for this cause.

MONPIEL may translate these Terms and Conditions, its Privacy Policy, or any other operating rule, policy or procedure that may be published on the Website. The English version shall prevail in case of conflict.

We expect our suppliers to regularly provide an environment that protects the health and safety of employees and their basic human rights. All suppliers shall comply with their national employment laws and regulations, in particular with respect to the following:

  • Minimum age for employment.
  • Freely chosen employment.
  • Health and safety.
  • Freedom of association and the right to collective bargaining.
  • Absence of discrimination.
  • Absence of harsh or inhumane treatment.
  • Working hours.
  • Labor conditions.

MONPIEL will never knowingly procure supplies from countries that fail to comply with the above principles. We also expect our suppliers to translate these principles into their dealings with their own suppliers. Due to the sometimes complex nature of our suppliers' supply chain, it is not always possible to monitor and control the conditions of each individual involved in the production of our products. However, as MONPIEL continues to grow, it recognizes the importance of acting proactively and doing everything possible to uphold the rights of the people involved in the manufacture of its products.

  1. CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, all personal data provided during the use of the Website will be treated in accordance with the provisions of the Privacy Policy that every User must expressly accept in order to use and register in the system.

  1. GENERALS

The headings of the various clauses are for information purposes only, and shall not affect, qualify or extend the interpretation of these conditions. Likewise, MONPIEL may modify the terms and conditions stipulated herein, in whole or in part, by publishing any change in the same form in which these conditions appear or through any type of communication addressed to Users.

The temporary validity of the present conditions coincides, therefore, with the time of their exposure, until they are totally or partially modified, at which time the modified conditions will become effective.

Independently of the provisions of the particular conditions that may be established, MONPIEL may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the Website, without the possibility for the User to demand any compensation. After such termination, the prohibitions of use of the contents set out above in these conditions shall remain in force.

Also, if the User breaches these conditions, MONPIEL may suspend or cancel your profile automatically and without notice, and in no case such suspension or cancellation would entitle the User to any compensation. To these effects, MONPIEL informs that it may inform and collaborate in a timely manner with the competent police and judicial authorities if it detects any infringement of current legislation or if it has suspicion of the commission of any crime.

The contracting of any product and/or payment service offered by MONPIEL shall be regulated by the general and/or particular conditions of each specific service provided for this purpose.

In the event of any discrepancy between the provisions of these conditions and the particular conditions of each specific service of the Website, the provisions of the latter shall prevail.

In the event that any provision of these conditions is declared null or unenforceable, in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or unenforceability shall not affect the remaining provisions of these Terms of Use.

The failure of MONPIEL to exercise or enforce any right or provision contained in these conditions shall not constitute a waiver thereof, unless acknowledged and agreed in writing by MONPIEL.

  1. NULLITY

All the clauses or ends of the present contract must be interpreted independently and autonomously, not being affected the rest of the stipulations in case one of them has been declared null by judicial sentence or firm arbitration resolution. The affected clause or clauses will be replaced by another or others that preserve the effects pursued by the Terms of Use of the Platform.

  1. LAW AND JURISDICTION

Wherever the regulations in force for this purpose provide for the possibility for the parties to submit to a specific jurisdiction, for any litigious matter arising from or related to this Website, the Spanish legislation in force at the time of the dispute shall apply, and we will submit to the Courts and Tribunals of Cordoba, as well as, if applicable, to the Consumer Arbitration Courts or similar to which we are adhered at the time of the dispute. Without prejudice to the foregoing, in accordance with Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users, in case of dispute we will submit to the Courts and Tribunals of the domicile of the consumer and User.

  1. DRESOLUTION OF DISPUTES

According to the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the settlement of consumer disputes online, in case of dispute, if the User so wishes,,, he/she may go to the "Commission's Dispute Resolution Platform" to try to resolve out of court any dispute arising from the provision of services by MONPIEL.
