These terms and conditions ("Terms and Conditions") govern browsing on the website www.monpiel.com (hereinafter the “Website”), owned by BIBOCCI, S.L. (“MONPIEL”), as well as the purchase of products offered by MONPIEL to consumers and users ("User" or "Users").

Any matter not expressly set out in these Terms and Conditions shall be reserved to MONPIEL, without prejudice to the application of the provisions of applicable legislation.

By ticking the corresponding box indicating acceptance of these Terms and Conditions, and by following all steps of the online process, the User expressly agrees to them, with the same validity as a handwritten signature. Therefore, the User acknowledges being of sufficient capacity to accept the obligations arising from actions performed on the Website, having previously read and understood these Terms and Conditions.

 

In any case, in order to enter into a contract with MONPIEL, the User must be of legal age (18+) and have the legal capacity to enter into binding contracts.

 

The User undertakes to use the Website correctly, in accordance with applicable laws, good faith, public order, and these Terms and Conditions.

 

The User shall be liable to MONPIEL, or to third parties, for any damages caused as a result of breaching their obligations.

The Website and its services are freely and publicly accessible; however, MONPIEL may require prior completion of the relevant form in order to access some of the services offered on the Website.

In accordance with applicable regulations, contracts concluded electronically shall produce all the effects provided for by law when consent and other necessary requirements for their validity are present. Following all the phases of the purchasing process and, where applicable, payment of the corresponding amount necessarily implies provision of the required consent to enter into the contract.

The contract between MONPIEL and the User shall be deemed concluded at the moment the User completes the contracting process by pressing the “PLACE ORDER”, “BUY” or similar button. Following all steps of the online process and completing the required fields, together with ticking the box indicating acceptance of these Terms and Conditions, shall be considered an express manifestation of the User’s willingness to accept them.

 

As a provider of an information society service, MONPIEL shall file the electronic document in which the contract is formalised. MONPIEL shall send the User an email confirming the successful completion of the purchase, along with the corresponding invoice.

 

MONPIEL shall implement appropriate and sufficient technical means to identify and correct any technical errors in the management of information, to the extent that it is responsible for them.

 

The language in which the contracting procedure shall be processed and in which this contract is formalised shall be Spanish, unless otherwise stated.

 

  1. PURCHASING PROCESS

The purchase of the products offered is carried out electronically through the Website. Any person with internet access may place an order, as all products offered through the Website are publicly accessible, without any restriction on viewing them.

 

After accessing the Website, the User must select the products they are interested in. It is important to carefully review the descriptions, features, conditions, delivery times, and final prices as indicated on the product page, and to specify the quantity desired for each item. The selected products will be added to the shopping “Cart” on the Website, where the User may continue shopping, and all selected products will remain in the “Cart”. The User may access their “Cart” at any time via the upper right-hand corner of the page.

 

Then, once the User has selected all the products they wish to purchase, they must begin the online checkout process by clicking the “CHECKOUT” button.

 

In order to proceed with the purchase, all required User information must be provided. The User must also complete the billing and shipping information. To this end, the User will be directed to a screen where they will be asked to fill in a series of personal and payment details, as well as make selections from the options provided by MONPIEL, all of which are essential to finalise the purchase through the Website.

 

In the “PAYMENT METHOD” tab, the User shall simply select the desired payment method from those offered by MONPIEL on the Website. If a payment incident occurs that prevents completion of the transaction, the User will receive an automatic payment error message, and the order will not be processed until payment is successfully completed.

  1. PRICING TERMS
  • PRODUCT PRICES

Each product will display its price at any given time on the Website, next to its description, and this information is publicly accessible.

 

Prices are shown in euros, unless expressly indicated otherwise.

 

The prices displayed are final prices and expressly include Value Added Tax (VAT) and any other applicable fees. However, the final price will also include any applicable increases or discounts, charges incurred by the User, and additional costs for optional services, payment methods, etc. In any case, all these amounts will be itemised and shown to the User during the checkout process.

 

  • PROMOTIONAL CODES

MONPIEL may occasionally offer discount codes to its Users. These discounts may only be applied in accordance with the specific instructions provided by MONPIEL for each code. In any case, only one code may be used per order.

 

Discount codes may not be used in conjunction with certain promotional actions and collections.

 

  • PAYMENT PROCESS

By accepting these Terms and Conditions, the User expressly agrees to receive their invoice electronically, if requested. Should the User prefer a paper invoice, they may contact MONPIEL and provide the postal address to which it should be sent.

 

Furthermore, in accordance with applicable law, MONPIEL may not modify the billing details of completed purchases. Therefore, the invoice shall be issued in the name of the individual placing the order, and Users must ensure the order is made using the correct name. Duplicate invoices cannot be issued for third parties, nor can they be issued once the warranty period has expired.

MONPIEL shall not be liable for product unavailability or delivery failures due to force majeure, theft, loss, or errors in the order or information provided by the User. However, in such cases, MONPIEL may contact the User to try to find the best possible solution.

 

  1. MODIFICATIONS

 

MONPIEL reserves the right to make changes or updates to these Terms and Conditions, which shall be communicated to the User in advance for acceptance or rejection, should they be substantial.

 

The User shall be deemed to have expressly accepted such changes or updates in the following case: when placing a new order, they will be required to expressly accept the new Terms and Conditions.

MONPIEL may translate these Terms and Conditions, its Privacy Policy, or any other operational rule, policy or procedure published on the Website. In the event of any conflict, the Spanish version shall prevail.

As a prestigious and reliable company committed to providing high-quality products to its customers, MONPIEL acknowledges its responsibility to ensure that its suppliers act ethically. We expect our suppliers to consistently provide an environment that protects the health and safety of employees and their basic human rights. All suppliers must comply with their national employment laws and regulations, particularly regarding:

  • Health and safety
  • Freedom of association and the right to collective bargaining
  • No discrimination
  • No harsh or inhumane treatment

MONPIEL will never knowingly source supplies from countries that do not comply with these principles. We also expect our suppliers to promote these principles throughout their own supply chains. Due to the sometimes complex nature of supply chains, it is not always possible to monitor or control the conditions of every individual involved in the manufacture of our products. However, as MONPIEL continues to grow, it recognises the importance of taking the initiative and doing all it can to uphold the rights of everyone involved in the production of its goods.

Without prejudice to any specific conditions that may apply, MONPIEL may terminate, suspend or interrupt, at any time and without prior notice, access to Website content, without the User being entitled to any compensation. Following such termination, the prohibitions on the use of content set out in these conditions shall remain in force.

 

Likewise, if the User breaches these conditions, MONPIEL may automatically suspend or delete their account without prior notice. In no case shall such suspension or deletion entitle the User to any compensation. In this regard, MONPIEL may report any breaches of applicable law or suspected criminal conduct to the appropriate authorities and cooperate fully with them.

 

The contracting of any product and/or paid service offered by MONPIEL shall be governed by the general and/or specific conditions applicable to the relevant service.

 

In the event of a discrepancy between these conditions and the specific conditions of any particular service offered on the Website, the latter shall prevail.

 

If any provision of these conditions is declared null or unenforceable, in whole or in part, by a competent court, tribunal or administrative body, such invalidity or unenforceability shall not affect the remaining provisions of these Terms of Use.

 

Failure by MONPIEL to exercise or enforce any right or provision contained in these conditions shall not constitute a waiver unless acknowledged and agreed in writing.

 

  1. SEVERABILITY

 

All clauses or sections of this contract must be interpreted independently and autonomously. The remaining provisions shall not be affected in the event that any of them is declared null and void by a final judicial or arbitral ruling. The affected clause(s) shall be replaced by others that preserve the effects intended by these Terms of Use.

 

  1. GOVERNING LAW AND JURISDICTION

 

Whenever the applicable legislation allows the parties to submit to a specific jurisdiction, any disputes arising from or related to this Website shall be governed by the laws of Spain in force at the time of the dispute, and we shall submit to the Courts and Tribunals of Córdoba, as well as, where appropriate, to consumer arbitration tribunals or similar bodies to which we may be affiliated at the time the dispute arises. Notwithstanding the foregoing, and in accordance with Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, in the event of a dispute we shall submit to the Courts and Tribunals of the consumer’s and User’s place of residence.

 

  1. DISPUTE RESOLUTION

 

As set out in Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution in consumer matters, in the event of a dispute, the User may, if they wish, use the “European Commission’s Online Dispute Resolution Platform” to attempt to resolve the issue extrajudicially with MONPIEL.
